THE OLDEST MOST SUCCESSFUL LEGAL GROUP IN THE WORLD has witnessed the achievement of many of its initial goals, but this month we have seen our biggest achievement, thanks to the Grievance Committee’s act to sanction the famed and controversial lawyer, Dominick Barbara (the bloated one), whose law license was suspended. The one and one-half year suspension brought about the firm’s downfall and Nassau D.A.’s investigation into allegations he bilked his clients of hundreds of thousands in fees.
Through the years, we have advised many litigants to write the Committee of the DR’s violated by Dominick. We hope their message will sober the actions of the other unscrupulous lawyers on our list.
So much more is happening in regard to legal reform. We hope you remain connected as we move forward. You have an ideal opportunity to do so by getting yourself and your friends involved in ALR or spearhead a committee or group of your own.

New York State should pass legislation requiring all persons wishing to become a judge pass a state-administered psychological test. More than 10 years ago, Robert Matherson, owner of the Oak Beach Inn, gave us one of his “Get out of New York State before it is too late” trucks. Originally, we had it painted “Stop the Lawyer Disease” but have since repainted it, “Mistreated by the Justice System.” Without conflict, we have parked the vehicle on the streets until the Town of Huntington recently ticketed us with two fines, totaling $1,000.00. ALR hopes this dispute does not evolve into a 20-year conflict as Bob had to endure with the OBI.

As a result of attorney Dominick Barbara Esq.’s suspension by the Grievance Committee for the Tenth Judicial District from the practice of law for 18 months (2009-10255) (Appellate Division 2nd Dept.) because he failed to send itemized bills, supervise the conduct of his firm, refund legal fees not earned and failed to communicate with his clients, the firm dissolved. The Grievance Committee finally responded to the many victims. We hope that they continue to do the duties to uphold the laws they were sworn to.

The Bar (lawyers), one group controls every aspect of our lives. They are the largest, richest, most powerful union in this country without regulation by anyone but themselves. Politicians and lawyers say:

We are entitled to the best quality people to handle the tremendous power of the judiciary. Many government employees are now required to have psychological evaluation prior to their appointment, such as state troupers, police, etc. New York State should pass legislation requiring that any person wishing to become a judge must pass a state-administered psychological test emphasizing honesty and integrity of the person(s), In doing so, it is reasonable to believe the quality and integrity of judges will be substantially enhanced. wonders why the same judges and lawyers names continue to come up when discussing problems with the judiciary? Back in May 1992, Newsday Front Page Headline “WHEN LAWYERS STEAL” Long Island, with the states highest theft rate, is especially vulnerable”. Newsday repeated the same lead story 15 years later “WORST OF THE WORST 1/29/07”. Crime stats across the country are down, yet the judiciary, which self-regulates its members can’t stop its own from abusing the public. Instead, good lawyers and judges continue to be powerless over bad lawyers and judges.
If a citizen discovers the justice system is comprised of corruption, partisanship, ineptness or stupidity and tries to change it, they get punished. Grievance committees and judicial commissions cover up the complaints. One just has to “Google” the three hearings by Senator John L. Sampson. A week doesn’t go by without a horrific story appearing before us. Obviously, one must conclude the judiciary can’t police its members. It’s time for change. Some may feel their experience with the courts is the most egregious. ALR believes Maria Composto-Longhi v. David Grossman Esq. wins the award (#27755/03). David Grossman Esq. and his criminal lawyer, James O’Rourke, have the education to navigate the legal system and use it to their distinct benefit, much to the detriment of his non-American born pro se ex-wife and their 2 physically disabled children and invalid daughter. Grossman and O’Rourke have misled the court to believe he was fired because of ALR. Yet the courts calendars refute his statements. Unopposed, family court Judge Richard Hoffman (F637708) found the needs of the children were not met and the assertions of Grossman Esq. were “without merit”. Upon Grossman, Esq. and O’Rourke’s emergency order to show cause, referee Jennifer Buetow and Judge M. McNulty ordered a retroactive downward modification Without Notice. They did not question Grossman’s $14 million line of credit, nor his lifestyle (7 vacations, 3 motorcycles, 2 boats, 3 cars, unlimited legal counsel and scalper tickets to World Series) while the children have been denied their basic needs,(wheel chair, diapers, heat and lifts, etc). The irony is that David Grossman Esq. and his firm, Kelly Grossman and Flanagan, make a more than ample living suing nursing homes for millions and have a Full Calendar, yet he denies his own disabled children’s needs.

goals are: Abolish self regulation of lawyers, make disciplinary hearings public, establish open public history of complaints against lawyers and judges, abolish laws that forbid non-lawyers from providing routine legal services, incorporate electronic recording devices to insure justice for all, require mediation in all disputes, use modern electronic methods to produce evidence, (i.e. tax returns, financial statements, bank statements), enforce perjury laws etc.
Surely these fundamental concepts should have come long ago from the judicial system itself. Yet, they haven’t and they won’t…unless we stand up and let it be known that “we’ve had enough”. All courtrooms are open, except in cases of child molestation. Pro se litigants were initially denied court watchers at fee dispute hearings (rule 137) but with the help of Amy Sheridan and Chief Administrative Judge Ann Pfau pro se litigants (defendants) are now allowed court watchers. Judge McNulty(judge #3)and Referee Buetow(judge #4) countered family courts upward modification of $1000/mth for the invalid child and imputed a 40 hr workweek to the pro se mother( Maria). While the father David, a lawyer, travels,( 6 vacations), plays with his 2 motorcycles, a Corvette and entertains himself at the World Series with scalper tickets. The father’s criminal lawyer appears more than 10 times, submits 1000’s of motion pages while the mother tries to find the children a doctor covered under the father’s cheaper insurance plan. Judge Bivona(judge #5) ignores NYS Court Rule 202.7 and pleas by the mother for financial and physical assistance.
“ The father again claims ALR got him fired from his previous partnership (they sue nursing homes) and has damaged his responsibility for the $14 million..” Judge Garguilio (judge #6) (Nov 20 2009 disposition). None of these four judges have thought to review the loan agreements to determine if the father has committed financial perjury in this divorce. Lawyer David lives in a luxurious house and enjoys a pool, gardeners, landscapers, laundry service and house cleaners, while his ex-wife Maria searches for time and $ to take care of the 3 handicapped children. This is not the first time Judge McNulty is behind such scandalous acts.(See Zagarino vs. Zagarino, index 018707-1997 and Galen vs. Galen, index 02595-01)
Compare the history of Glen Svabota, a blue collar worker who went to jail for 3 mths. because he couldn’t pay $3500 child support, and David Grossman a lawyer, who owes his handicapped children $14000. Grossman has been judge shopping for nearly 2 years, 6 judges, 1000’s of pages of motions, with 15 hearing dates, with no law guardians for the children, violating the Children’s Disability Rights only because he is an officer of the court.

He doesn’t even bother to reply to our phone calls/letters (June 09 mailed to all NY legislators and judges) asking for 1. Improved procedures in divorce discovery to avoid delays 2. Enforced penalties for perjury with respect to finances including punishments for the attorneys. Sooner or later the public will get fed up with the lack of accountability in the courts. Court Watchers Update: 1. Ex-husband David Grossman Esq. and his criminal lawyer James O’Rourke, a former partner of District Attorney Spota, continue to embarrass the profession with their court antics while Grossman’s three handicapped children are in desperate need of chairs, lifts, and supplies. Grossman wants his ex-wife to get a job during the few hours the kids are in public care so he doesn’t have to pay back child support. He spent thousands to reverse the family court’s orders to pay an extra $1000/mth child support. Then, he immediately took another vacation on a secret island with the money he saved on the downward modification by Judge Buto. By the way, Grossman makes his money suing nursing homes that don’t take proper care of patients. 2. Some judges shouldn’t be, i.e., Judge McNulty(S). When Mr. & Mrs. Galen stipulated an agreement regarding their children’s visitation, McNulty ordered their butts into court to scold them, pretending she cared about the children. Yet, she ripped the Zagarino children out of L.I. schools and sent them 150 miles away to be with a stepmother and parent who care little for the children’s welfare. The Zagarino children currently don’t even have a stepmother. (Index # 018707-1997 S)

Letters are going to our legislatures asking them to sponsor a bill for digital recordings in all NYS trial courts, institution of an official court watchers program by law schools and/or district attorneys, public lecture programs, picketing, fund raising, and more. ALR has been working hard for 20 years, yet never a month goes by that we aren’t shocked by the atrocities of inept, corrupt judges and lawyers in our legal system. Christy Brinkley is given the fast track for her 4th divorce, a pro se mother of three handicapped children is on no track to petition her ex-husband/lawyer for more money for the kids, and the new guardianship court gives 5 rotten kids control of their wealthy father’s money. Just because someone is a lawyer does not make them a good law-maker. The hearing to draft rules governing federal judicial misconduct complaints for the entire nation was held for only 2 hours, Sept.27,2007 in Brooklyn NY. Only three speakers were heard by the committee chair, Judge Stephen Brey. The first, a good old boy Arthur Helman Esq., and two gentlemen, a Dr. Richard Cordero Esq.(www.judicial-discipline-reform.org) and Frank Knize (Frankknee@aol.com ) who filmed the entire event. Under the current rules, the judges took disciplinary action against their peers in only 14 cases out of the 7462 complaints filed in the past 10 years. In the 218 years since the adoption of the constitution, only seven judges have been removed. 99% of all complaints are dismissed in secrecy.

Chief Judge Judith Kay called for change in the way judges are elected, citing undue control by party leaders and unconstitutional elections.(Feb.6 Annual State of the Judiciary address).
Through the years many complaints have been made about Taylor Walkers’ Esq. incompetence, probably a result of his substance abuse. Most recently we have observed his despicable actions, suing a defenseless litigant before the incompetent Judge Martin J. Massel, District Ct. Hempstead, for $13000 in fees. As long as judges protect their buddies with unjust awards, the system will never work. Next time, Taylor should be permanently disbarred. Vice President Chaney did his part- he shot a lawyer.
Edward Cashmana, VT District Court Judge, sentenced a man who confessed to raping a 10 year old child 50 times, to only 60 days.(IBD 1/13/06)
The most frivolous awards: A Texas woman was awarded $78,000 after breaking her ankle tripping over her own toddler in a store. A 19 year old man won $74,000 when his neighbor ran over his hand while he was stealing same neighbor’s hubcaps. An Oklahoma man won $1.7 million when he crashed his Winnebago after setting the cruise control and going to make himself a cup of coffee. There was no warning label.

If you think only state courts are crooked think again. A Federal Court Judge on L.I., Judge Francis Conrad, was suddenly disrobed- possibly because he forgot to mention to the litigants he was friends with one of the lawyers before him, John Westerman Esq. He continued this relationship as an arbitrator and once again did not disclose that he had a relationship with Westerman et al.(US Bankruptcy Court Southern District NY 02-14758 PCB) Had the courts disclosed to the public why he was disrobed it would have prevented a recurrance of the events. Instead, the courts chose to conceal their findings leading up to Conrads dismissal. Who is responsible for this?

In CA., complaints against judges and lawyers are reviewed by citizens, the majority of whom are not in the legal profession. Hearings are open to the public, not closed as in NY. The committee reviewing judicial and legal conduct is properly funded and can carefully review misconduct allegations. New York has bad judges because the system that reviews judicial conduct is a closed political system. Open up the process so fresh air can circulate.
